ข้อตกลงว่าจ้าง1. การชำระเงินค่างาน
- กรณีที่งานมีราคาสูงกว่า 1,000 บาท ผู้ว่าจ้างจะต้องจ่ายเงินมัดจำ 30-50% ของราคาเต็ม หรือจ่ายเต็มราคา ภายใน 5 วัน หลังจากที่ใบเสนอราคาได้รับการตอบตกลง- กรณีงานที่ราคาน้อยกว่า 1,000 บาท ผู้ว่าจ้างสามารถจ่ายเงินเต็มจำนวนครั้งเดียวเมื่องานเสร็จสมบูรณ์ได้
หากผู้ว่าจ้างไม่สะดวกจ่ายเงินมัดจำภายในช่วงเวลาดังกล่าว โปรดแจ้งก่อนล่วงหน้า กรณีที่ผู้ว่าจ้างไม่แจ้งล่วงหน้าและไม่จ่ายเงินภายในเวลาที่กำหนด จะนับว่างานนั้นถูกยกเลิกทันที (ข้อ 5) ทั้งนี้ ผู้ว่าจ้างต้องส่งหลักฐานการจ่ายเงินเพื่อยืนยันการชำระเงินทุกครั้ง2. รับงานสองประเภทคือ ใช้ส่วนตัว และใช้เชิงพาณิชย์ (นำไปใช้หารายได้) โดยราคาเชิงพาณิยช์จะคิดราคา 2 เท่าจากราคาปกติ (อาจมีการเปลี่ยนแปลงราคาตามตกลง) หากพบในภายหลังว่าผู้ว่าจ้างนำผลงานประเภทใช้ส่วนตัวไปใช้เชิงพาณิชย์จะมีการปรับจำนวนเงินตามสมควรเพราะถือว่าผู้ว่าจ้างได้ละเมิดข้อตกลงว่าจ้าง เพื่อหลีกเลี่ยงปัญหาจนถึงขั้นฟ้องร้อง กรุณาแจ้งขอบเขตการใช้งานให้ชัดเจนและครบถ้วนตั้งแต่ก่อนเริ่มงาน3. ในขั้นตอนร่าง (Sketch) สามารถแก้งานได้ทั้งหมด 4 ครั้ง ในขั้นตอนการตัดเส้นสามารถแก้ไขได้ 2 ครั้ง (หากเกินจาก 2 ครั้ง จะคิดเงินเพิ่มในทุกครั้งที่ผู้วาดต้องทำการแก้ผลงาน) การแก้ไขผลงานในขั้นตอนที่ใกล้เสร็จสมบูรณ์ หรือหลังจากผลงานเสร็จสมบูรณ์แล้ว จะมีการคิดเงินเพิ่มและจัดทำใบเสนอราคาฉบับใหม่4. กรณีที่ยกเลิกงานกลางคันเนื่องจากความประสงค์ของผู้ว่าจ้าง จะไม่มีการคืนเงินมัดจำ แต่หากการยกเลิกงานกลางคันเกิดจากการที่ผู้วาดไม่สามารถทำผลงานต่อให้เสร็จได้ ผู้วาดจะทำการคืนเงินมัดจำให้กับผู้ว่าจ้างทันที5. กรณีที่ผู้ว่าจ้างไม่สามารถชำระเงินค่าจ้างภายในเวลาที่ตกลงกันไว้ โปรดแจ้งล่วงหน้าก่อนถึงวันนัดชำระอย่างน้อย 48 ชั่วโมง โดยสามารถเลื่อนนัดชำระได้ทั้งหมด 2 ครั้ง ครั้งละไม่เกิน 10 วัน อย่างไรก็ตาม หากผู้ว่าจ้างไม่แจ้งล่วงหน้าหรือเลื่อนวันนัดชำระจนครบ 2 ครั้งแล้ว เมื่อเลยกำหนดนัดชำระเป็นเวลา 10 วัน จะถือว่าลูกค้าไม่ชำระค่าจ้างภายในเวลาที่กำหนด ผู้วาดมีสิทธิ์นำผลงานไปดำเนินการต่อตามสมควร (เช่น ขายต่อ) รวมถึงบันทึกชื่อผู้ว่าจ้างลงในรายชื่อแบล็กลิสต์ (Blacklist) ซึ่งผู้อื่นสามารถขอดูรายชื่อได้6. ลิขสิทธิ์ของผลงานที่เสร็จสมบูรณ์เป็นของผู้ว่าจ้างภายใต้ขอบเขตการใช้งานตามที่ทำข้อตกลงกันไว้ ไม่อนุญาตให้ผู้ว่าจ้างแอบอ้างว่าเป็นผู้วาดและนำผลงานไปใช้งานนอกเหนือจากที่ได้ทำข้อตกลงกันไว้ ไม่อนุญาตให้นำผลงานไปใช้ในการสร้างภาพด้วย AI นำไปขายเป็นสินทรัพย์ดิจิตัล (NFT) หรือนำไปใช้สำหรับ Machine Learning โดยผู้วาดมีสิทธิ์นำผลงานไปแสดงใน Portfolio ใช้เป็นภาพตัวอย่างงาน เผยแพร่ผลงานแบบติดลายน้ำในโซเชียลมีเดีย นำผลงานไปขายต่อในกรณีที่ผู้ว่าจ้างไม่ชำระค่าจ้างตามกำหนด หากผู้ว่าจ้างไม่อนุญาตให้เผยแพร่ผลงานจะต้องทำข้อตกลงห้ามเผยแพร่ผลงาน (NDA) กับผู้วาดตั้งแต่ก่อนเริ่มงาน และจะมีการเก็บค่าไม่ให้เผยแพร่ผลงาน==ขั้นตอนและข้อตกลงในการทำงาน=๐ หลังจากลูกค้าทำการส่งบรีฟมาแล้ว นักวาดจะส่งใบเสนอราคาให้ทางอีเมลล์ ภายใน 2 สัปดาห์ หากลูกค้าตอบตกลงใบเสนอราคาฉบับดังกล่าว จะถือว่าลูกค้ายอมรับในข้อตกลงว่าจ้าง และตกลงที่จะซื้อสินค้า/บริการ แล้ว๐ เมื่อเงินลูกค้าชำระเงินมัดจำเรียบร้อยแล้ว นักวาดจะแจ้งเวลาเริ่มงานให้กับลูกค้า หากนักวาดไม่ดำเนินการตามวันเวลาที่แจ้ง ลูกค้าสามารถขอเงินมัดจำคืนได้๐ นักวาดจะทำการส่งไฟล์งานที่เสร็จสมบูรณ์ให้กับลูกค้าเมื่อได้รับเงินค่าจ้างเต็มจำนวน หากไฟล์งานมีปัญหาหรือไม่ได้รับอย่างไร โปรดแจ้งทันที๐ กรุณาบรีฟให้ละเอียดชัดเจนเพื่อความเข้าใจที่ตรงกัน และเพื่อผลงานที่น่าพึงพอใจมากที่สุด

AGREEMENT
For international client, please send a request via VGen1. Payment will be accepted in full, or half up front if the commission exceeds $30. Low price commissions can be paid after the work is fully done. If the deposit is not paid within the agreement date without an advance notice, the work will be cancelled automatically. No deposit refunds after I started the work process.2. I accept both personal and commercial use commission, commercial use will be x2 from the normal price. If it is found out later that the personal type of work is used for commercial purposes, client will have to pay extra charges.Personal use : Works that are not going to be sold or used to make profit, only serving your own interest or personal purposes such as, using for a role-play community, giving as a gifts etc.Commercial use : Works that are going to be used to make profit, published (offline/online) as a self-advertisement, or used as a part of merchandise (any kind) , for examples a book cover, novel illustration, art that related to or going to be published by Vtuber/Streamer etc.3. Client can make an unlimited change in a line-sketch process. In a line-art process, 2 times changes are allowed (only minor changes). If exceed 2 times there will be an extra charge per time you make a change.
There will be additional charges if you want to make a revision after the completion of the work.4. If the work is cancelled due to client's demand, no deposit refund. But if the cancellation is due to the artist circumstance, the deposit will be refunded immediately.5. Please send detailed references or photos of your character e.g., pose, background, accessories, etc.
this helps me understand your commission brief better.6. Crediting is greatly appreciate.7. All copyright over my works. Which include but are not limited to the right to distribute, reproduce or use the image as a sample for self-promotion. Client CAN NOT sell the commission work as NFT and CAN NOT use the work for AI generate/learning.8. In case that client can not pay the full price within the agreement day, please make an advance notice at least 1 day before the due date. If client do not make an advance notice and do not pay the full price in 20 days from the due date, I will have rights to resell the work and put client's name into the blacklist.
